Regulation under the Safety Codes Act
STANDATA
Alberta Municipal Affairs Minister Danielle Larivee signed a Ministerial Order, effective December 30, 2016, to amend the Exemption Regulation under the Safety Codes Act so that residences of adults with developmental disabilities are not subject to care or treatment standards under the building and fire codes.
This decision supports recommendations that residences of adults with developmental disabilities should be treated no different than any other home when interpreting and applying safety codes.  Safety codes inspections will not occur in homes where adults with developmental disabilities live, unless there is a request, incident or complaint - as is the case with any other home in Alberta.  Alberta Human Services had noted that the application of safety codes has been of significant concern for many individuals and their families.
For more information and detail, refer to the December 20, 2016 joint letter issued by the Minister of Municipal Affairs and the Minister of Human Services. The Exemption Regulation will be posted on the Alberta Municipal Affairs website in the near future for easier reference.

The August 2015 STANDATA is no longer in force or effect.  See:

Building Code Act
The Regulatory Registry Alert advised on December 16, 2016 that the Ontario government launched the Red Tape Challenge for "Financial Services: land use and planning regulations", including the Building Code Act.  The Red Tape Challenge for Financial Services will be active from December 1, 2016 to January 31, 2017.  A final report is expected to be available on July 31, 2017.
According to the Red Tape Challenge web site:
"The Red Tape Challenge is an online consultation platform designed to engage businesses, the public, and other stakeholders to help identify and improve Ontario regulations that are unclear, outdated, redundant or unnecessarily costly for business. Help Ontario cut red tape; submit your ideas today!"
The Building Code Act page has a very simplistic question about the Building Code Act:
"Tell us what to do with this regulation [sic]
   - Keep it the same
   - Improve it
   - Eliminate it
- Tell us more:"
It is not clear what the government will do with the responses, other than publish a report on July 31, 2017.

Building Code Regulations
Joe Rogers, P. Eng., Building Code Coordinator for the Province of Nova Scotia, has announced proposed amendments to the Nova Scotia Building Code Regulations pursuant to the Building Code Act, R.S. N.S. 1989, Chapter 46, which are expected to come into effect on or about April 1, 2017.

The proposed amendments are required due to the issuance of the 2015 editions of the National Building Code, National Plumbing Code and National Energy Code for Buildings.  In addition to the adoption of the 2015 Codes, these amendments are proposing to remove the Nova Scotia-only provisions for sprinkler systems and align the requirements for sprinklers within Nova Scotia with the rest of Canada.  Schedule “C” of the proposed regulation increases accessibility and provides for adaptability within a residence should a need arise.  This is applicable to all newly constructed residential buildings.  There are no requirements to retrofit existing buildings.

The proposed amendments have been vetted by the Nova Scotia Building Advisory Committee, which had an opportunity to review the proposed amendments and agreed that they should move forward.

Copies of the proposed replacement regulation has been attached and will soon be  available for inspection online at: Joe Rogers, P. Eng., Building Code Coordinator welcomes your comments (on or before January 20, 2017) and questions and can be reached by:

Supplementary Standard SB-10
The Ministry of Municipal Affairs has shared a draft of “Supplementary Standard SB-10: Energy Efficiency Requirements” with "key" stakeholders in the building, design, manufacturing and government sectors to help finalise this standard.  The revised contents of Supplementary Standard SB-10 include ways to meet the energy efficiency requirements for buildings in the Building Code that will come into effect as of January 1, 2017.  The Ministry has asked for comments by October 21, 2016.

The consultation documents consist of:
  • a proposed draft of Supplementary Standard SB-10
  • a "Background Document", dated September 30, 2017, which includes instructions on how to comment on the proposed revisions to SB-10.
If you did not get a copy of these documents, the Ministry of Municipal Affairs does not consider you a "key" stakeholder.
CodeNews.ca believes that the design and construction industry should operate on a level playing field and that all Code users should have equal access to proposed code changes.
Ontario should not degenerate into a Clintonesque banana republic where "pay to play" and other filth is the norm.
Every user of the Ontario Building Code is a "key" stakeholder.

Therefore, in the spirit of Snowden, Assange, and others, CodeNews.ca has published the proposed draft of Supplementary Standard SB-10 here.

In its September, 2016 issue of "RESCON Industry News", RESCON has announced that it is collaborating with the  Ontario Ministry of Natural Resources and Forestry to develop an alternative solution for the current Ontario Building Code: this would involve creating a guideline to be used by designers, builders and municipal building departments, that would lead to mid-rise mass timber construction that is safe and performs as well or better than what’s outlined in the Ontario Building Code.
It will be interesting to see whether the Ontario Ministry of Municipal Affairs will approve an alternative solution joinlty developed by industry and another Ontario Ministry.

03-AUG-2016NOVA SCOTIA
Building Code
Following extensive public consultation, Joe Rogers, P. Eng., Building Code Coordinator for the Province of Nova Scotia, has announced that new changes to the Nova Scotia Building Code Act Regulations came into effect on August 1, 2016.

These changes exempt home-based businesses from some of the rules in the regulations and will benefit home-based businesses in Nova Scotia.  Home-based businesses no larger than 25 per cent of the total floor area (50 m2) of a home that the business owner occupies will be exempt from certain parts of the Building Code Act Regulations intended for commercial spaces.
These exemptions include:
  • Requirements for wider doors and a barrier-free entrance;
  • Fire separations, loading, fire-rated doors with self-closures; and
  • Additional washroom facilities.
These changes will:
  • bring clarity to business owners and Building Officials; and
  • prevent undue regulatory burden for home-based businesses.
These changes demonstrate Nova Scotia's concern for its home-based businesses and taxpayers, unlike Ontario which continues to pander to emissions trading banksters and minority special interest groups at the expense of its taxpayers.

Climate Change Action Plan
Ontario Building Code

On June 8, 2016, the Office of the Premier issued a new release to announce Ontario's Five Year Climate Change Action Plan for 2016 - 2020. This 86 page document promises to reduce emissions from fossil-fuel use in buildings in the following ways:
  • 4.1  "Ontario intends to help homeowners purchase and install low-carbon energy technologies such as geothermal heat pumps and air-source heat pumps, solar thermal and solar energy generation systems that reduce reliance on fossil fuels for space and water heating."

    • Estimated cost to you and me: $500,000,000 to $600,000,000

    • Timetable:  Start in 2017/18

    •  [In other words, the government will give your tax $$$ to people who own million dollar homes to lower their energy bills.]

  • 4.2  "A new program targeting northern and rural communities, including Indigenous communities, would encourage households to switch out older polluting wood stoves for new high-efficiency wood stoves."

    • Estimated cost to you and me: $1,000,000 to $4,000,000

    • Timetable:  Start in 2017/18

  • 4.3  "Rebates will go to individuals who purchase or build their own near net zero carbon emission homes, with energy efficiency performance that sufficiently exceeds the requirements of the Building Code. In addition to reducing the higher up-front costs for homebuyers, this program will encourage construction of high-efficiency homes that pollute less."

    • Estimated cost to you and me: $180,000,000 to $220,000,000

    • Timetable:  Start in 2017/18

    • [In other words, the government will give your tax $$$ to people who want to build their own multi-million dollar mansions - Can't wait! - Where do I apply???]

The Building Code will be updated, as follows:
  • 5.1 "The government intends to update the Building Code with long-term energy efficiency targets for new net zero carbon emission small buildings that will come into effect by 2030 at the latest, and consult on initial changes that will be effective by 2020. Ontario will consult on how to best achieve these targets through Building Code improvements."

The Globe and Mail's Adrian Morrow and Greg Keenan published details about the Ontario government's climate change plan, which includes:
  • Ontario Building Code changes to ensure that all “new homes and small buildings”, built in 2030 or later, do not use fossil fuels, such as natural gas, for heat or cooling; by 2050, this requirement would apply to all buildings.
  • The Ontario Building Code changes to require all major renovations improve energy efficiency, such as by using better insulation.
  • Municipalities will also be allowed to impose even tougher energy efficiency standards than those contained in the Ontario Building Code.
The Globe and Mail reports that:

The revised contents of Supplementary Standard SB-12 include ways to meet the energy efficiency requirements for houses in the Building Code that will come into effect as of January 1, 2017.
If you did not get a copy of the draft, you are not a "key" stakeholder.  Schmucks who were not consulted by the Ministry will have to wait for the revised standard to be published in order to know what is in it.

Build Right Ontario
Aubrey L. LeBlanc, M.Sc. MBA, Chief Administrative Officer, Ontario Building Officials Association, announced on December 23, 2015 that a single technical website called Build Right Ontario has been established by a consortium of three building regulatory organizations:
  • LMCBO (Large Municipalities Chief Building Officials)
  • OBOA (Ontario Building Officials Association)
  • TACBOC (Toronto Area Chief Building Officials)
The purpose of the Build Right Ontario website is to:
  1. Be the central repository of information and interpretation relating to the Ontario Building Code, Act, and related standards and technical information; and
  2. Better serve the information and professional needs of the building regulatory community in Ontario.
The Build Right Ontario website is organized in seven areas: five are public and two are restricted to those with a password.

One of the public areas is a Building Code Training Course Registry, offered at OBOA Head Office in Woodbridge, or through OBOA chapters, community colleges, or municipalities under contract to OBOA, or online.

One of the restricted areas is a large Reference Library of technical documents in various categories (the largest segment of the site).  Over the first few months of 2016, a significant portion of the Reference Library will not require a password and be accessible to the public.
